Enterecom HOSTING and SALES AGREEMENT

You must understand and agree to the following facts, terms and conditions:

The software used to build and manage your Web site is a product of Enterecom  (hereafter "Enterecom").

Enterecom does not sell any software to you. Enterecom leases its system to you to be used in the act of creating and publishing your Web site on the Internet.

Enterecom allows you to upload your information and images to your Web site, using our system. However, you must first agree to follow all legal rules regarding content. These rules include the following:

You may not upload anything that:
(a) may be considered deceptive
(b) may be defamatory or libelous, lewd, or obscene.
(c) may be racist, threatening, harassing, libelous, or a violation of intellectual property laws
(d) promotes stolen, pirated or unlicensed copyrighted material
(e) violates any laws regarding unfair competition, anti-discrimination or false advertising;
(f) contains viruses, Trojan horses, worms, time bombs, cancel bots or other similar harmful programming routines.
(g) infringes on any third party copyright, patent, trademark, trade secret or other proprietary rights or right of publicity or privacy;
(h) violates any applicable law, statute, ordinance or regulation;

You may not send the following types of emails:
(a) spam emails, opt-in emails, soliciting emails, pseudo emails, impersonating emails, or other unwanted emails using our software to email addresses (persons) that have not joined your email list willfully or have not purchased your products or services online.

All materials deemed to be in violation of any of these rules are subject to removal at the discretion of Enterecom.

To clarify further: Enterecom Internet services are all Client/Server systems, which means that all software code remains on Enterecoms servers at all times. You are leasing our system for use in selling your products or services.

Enterecom will provide a secure, password-protected manager console from which you, the client may update, add to and remove items as well as retrieve orders placed.  You must keep your password private at all times. If your password is compromised and you can not change it using the manager console, you agree to contact Enterecom immediately to change your password.

Enterecom will not be held responsible for neither down time nor damages resulting from downtime. All applicable setup & installation fees are non-refundable.

Enterecom does not allow for the resale of the Enterecom system by customer, nor does Enterecom sell the source code of the system.

You are allowed up to 5000 visitors per month with additional blocks of 5000 at the price of $25.00/month. Upon the 5001 visitor our system will automatically add an additional block of 5000.

You are allowed up to 250 products to sell. Up to 500 add additional $15.00/month, Up to 1000 add additional $30.00/month.

Website Financing Option*/**
Financing will be for a 12 or 24 month term at 0% interest. By accepting this hosting agreement you agree to be financially responsible for all fees and resonable attorney fees associated with the recovery of funds due to Enterecom. EnterEcom will charge you 5% interest compounded monthly for all balances due from all invoices 60 days past due, regardless of websites status as live or not. This financing agreement is a binding contract. You are agreeing to lease this website for the selected number of months at the selected monthly price. Default of this contract and agreement will be governed by the courts of Clackamas County in the State of Oregon.

Invoiced Customers*/**
For monthly invoiced customers paying by check there is a $35.00 fee for all returned NSF checks. Your website may be disabled for any NSF check not payed within 3 business days of notification by EnterEcom. EnterEcom will no longer accept monthly invoiceing for your hosting or website purchase and you must pay 6 months in advance for all hosting and the balance of your website purchase must be paid in full. EnterEcom will require first months invoice to be paid within 3 business days of activation of website. Failure to do so will suspend your site until payment is received.
All websites that are invoiced and are disabled as a result of late payment will result in a $50.00 reactivation fee. All invoices that are paid late will be charged a $10.00 late fee.

Payments and Hosting Fees:
You authorize Enterecom to charge either your credit card or do an ACH billing for all invoices, set up fees, past due amounts and monthly hosting fees. These charges will automatically deduct from your checking account, credit card or debit card. Payment by check (subject to clearance before activation). You can pay in full, semi-annually or set up for automatic debit every month or 3 months for the 12 month duration of the contract.  This hosting agreement renews every three months unless cancelled in writing by client. There are no refunds for hosting fees cancelled at any time during the year contract.  You may choose to not renew any yearly hosting by sending written notice to:
